General Terms and Conditions (GTC)

for midwife Alanna Mouhib

 

1. Scope

These General Terms and Conditions apply to the contractual relationship between midwife Alanna Mouhib and the service recipient, unless otherwise agreed.

2. Legal Relationship

The relationship between midwife Alanna Mouhib and the service recipient is private and not subject to public law.

3. Services Provided

  1.  Services are provided based on the agreement on midwifery care under Section 134a of the German Social Code (SGB V), which was agreed upon by midwifery associations and the national health insurance association.
  2. If the service recipient is a self-paying client, services are charged according to the private fee schedule of the federal state where the service is provided. (*)
  3. Midwife Alanna Mouhib does not provide medical services performed by doctors or medical transport. Any such additional services must be paid for separately by the service recipient.
  4. If appointments are missed without prior cancellation, the midwife reserves the right to terminate the contract and discontinue the provision of care.

4. Optional Services

1. Additional services that are not covered by health insurance may be booked separately. These include:

  • Laboratory tests
  • Laser therapy
  • Courses
  • Massages
  • Other services as agreed

2. Some services are covered by health insurance only up to a certain limit. If this limit is exceeded, the additional costs must be paid by the service recipient. This applies to:

  • More than 12 pregnancy consultations
  • More than 16 contacts (in person or by phone) between the 11th day after birth and eight weeks postpartum
  • Travel expenses beyond what the health insurance covers

3. The midwife will inform the service recipient in advance about any costs for optional services.

5. Payment and Billing

1. For clients with statutory health insurance, the midwife will bill the health insurance provider directly. Optional services are not covered and must be paid for separately.

2. Clients whose costs are covered by a public institution (e.g., government employees with medical aid) must provide proof of coverage. If coverage is not confirmed, the client must pay as a self-payer.

3. Self-paying clients must pay for services based on the private fee schedule of the federal state where the service is provided. The client is responsible for checking with their health insurance whether they will be reimbursed.

4. The invoice amount is due upon receipt. Late payments may result in interest charges (according to Section 288 of the German Civil Code) and a reminder fee of €5.

5. Offsetting payments against disputed or unconfirmed claims is not allowed.

6. If optional services are booked, the midwife may request an advance payment.

 

6. Effective Date

These General Terms and Conditions take effect upon registration.

7. Validity of Terms

If any part of these terms is found to be invalid, the rest will remain in effect. The invalid part will be replaced with a valid rule that comes as close as possible to the original intent.

 

(*) In Saxony, where no private fee schedule exists, fees are based on the private fee schedule of Saxony-Anhalt.
